Fly Fishing Oman – Terms & Conditions

1. Introduction

These Terms & Conditions govern all bookings made with Fly Fishing Oman ("the Company"). By making a booking, paying a deposit, or participating in any trip, charter, or package offered by Fly Fishing Oman, you agree to be bound by these Terms & Conditions.

Fly Fishing Oman operates guided saltwater fly fishing trips, fishing charters, accommodation packages, and related tourism services within the Sultanate of Oman.

2. Booking Confirmation

A booking is considered confirmed only when:

• A  completed booking form has been received.
• The required deposit has been paid.
• Written confirmation has been issued by Fly Fishing Oman.

The Company reserves the right to refuse any booking at its discretion.

3. Deposits and Payments

• A   non-refundable deposit of 50% of the total package price is required to secure a booking unless otherwise agreed in writing.
• The remaining balance must be paid no later than 60 days before the commencement of the trip.
• Bookings made within 60 days of arrival require full payment at the time of booking.
• Failure to pay the balance by the due date may result in cancellation of the booking without refund of the deposit.

4. Cancellation by the Client

All cancellations must be submitted in writing.

The following cancellation charges apply:

• More than 120 days before arrival: 100% refund of deposit.
• 60–120 days before arrival: 50% refund of deposit.
• Less than 60 days before arrival: 0% refund.

If the Company can resell the cancelled dates, a partial refund may be offered at the Company's sole discretion.

No refunds will be issued for:

• Late arrival.
• Early departure.
• Unused accommodation.
• Unused guiding days.
• Missed flights or travel connections.
• Failure to obtain travel documentation.

5. Travel Insurance

Comprehensive travel insurance is strongly recommended and should include:

• Trip cancellation.
• Medical expenses.
• Emergency evacuation.
• Personal accident coverage.
• Loss or damage to baggage and fishing equipment.

Clients are responsible for ensuring they have adequate insurance coverage.

6. Weather and Fishing Conditions

Fishing is a natural outdoor activity, and conditions can vary significantly.

Fly Fishing Oman does not guarantee:

• Catch rates.
• Particular species.
• Weather conditions.
• Water conditions.
• Fishing success.

No refunds or compensation will be provided due to:

• Poor weather.
• Wind.
• Rain.
• Rough seas.
• Reduced visibility.
• Changes in fish behaviour.
• Any other environmental conditions beyond the Company's control.

7. Changes to Itinerary

The Company reserves the right to modify:

• Fishing locations.
• Daily schedules.
• Accommodation arrangements.
• Boat assignments.
• Guides.

Such changes may be necessary due to weather, safety concerns, mechanical issues, government regulations, or operational requirements.

8. Cancellation by Fly Fishing Oman

The Company reserves the right to cancel or modify any trip due to circumstances beyond its reasonable control, including but not limited to:

• Extreme weather.
• Government restrictions.
• Civil unrest.
• Natural disasters.
• Health emergencies.
• Mechanical failures.

In such cases, Fly Fishing Oman will endeavour to offer alternative dates or a credit toward a future trip.

The Company's liability shall not exceed the amount paid directly to Fly Fishing Oman for the affected services.

9. Health and Fitness

Clients are responsible for ensuring they are physically capable of participating in fishing activities.

Participants must inform the Company before arrival of any medical condition, injury, allergy, or dietary requirement that may affect their participation.

The Company reserves the right to refuse participation if a client's condition may create a safety risk.

10. Safety

All participants must follow the instructions of guides, boat captains, and staff at all times.

The Company reserves the right to terminate a trip without refund if a participant:

• Acts recklessly.
• Endangers others.
• Is under the influence of illegal substances.
• Refuses to follow safety instructions.

11. Liability

Participation in fishing and boating activities involves inherent risks.

Clients participate entirely at their own risk.

To the fullest extent permitted by law, Fly Fishing Oman, its owners, guides, employees, contractors, and agents shall not be liable for:

• Personal injury.
• Illness.
• Death.
• Property loss.
• Equipment damage.
• Travel disruption.
• Consequential or indirect losses.

Nothing in these Terms excludes liability where such exclusion is prohibited by applicable law.

12. Fishing Equipment

Clients are responsible for any personal fishing equipment brought on the trip.

Any equipment supplied by Fly Fishing Oman remains the property of the Company and must be returned in reasonable condition.

The Company reserves the right to charge for loss or damage caused through negligence or misuse.

13. Photography and Media

Fly Fishing Oman may photograph or film participants during trips.

Unless the client notifies the Company in writing before arrival, the Company may use such images and videos for:

• Marketing.
• Social media.
• Website content.
• Promotional materials.

No compensation shall be payable for such use.

14. Use of Personal Information

Fly Fishing Oman is committed to protecting the privacy and security of its clients' personal information.

By making a booking, submitting an enquiry, subscribing to marketing communications, or otherwise interacting with the Company, you consent to the collection and use of personal information as described below.

The Company may collect personal information including, but not limited to:

• Name.
• Postal address.
• Email address.
• Telephone number.
• Nationality and country of residence.
• Emergency contact details.
• Travel information relevant to the booking.
• Payment and billing information.
• Information voluntarily provided through enquiry forms, booking forms, surveys, or correspondence.

Personal information may be used for the following purposes:

• Processing and managing bookings.
• Communicating with clients before, during, and after a trip.
• Providing accommodation, guiding, transport, and related services.
• Issuing invoices and processing payments.
• Responding to enquiries and customer service requests.

• Sending newsletters, special offers, and marketing communications where consent has been provided.

Fly Fishing Oman may share personal information with trusted third-party service providers where necessary to deliver services, including payment processors, accounting software providers, email marketing platforms, accommodation providers, transportation providers, and government authorities where required by law.

The Company will not sell, rent, or trade personal information to third parties for their own marketing purposes.

Personal information will be retained only for as long as reasonably necessary to fulfil business, legal, accounting, or regulatory obligations.

Clients may request access to, correction of, or deletion of their personal information by contacting Fly Fishing Oman using the contact details provided on this website. The Company will make reasonable efforts to comply with such requests, subject to applicable legal and operational requirements.

15. Force Majeure

The Company shall not be liable for failure to perform its obligations where such failure results from events beyond its reasonable control, including:

• Epidemics or pandemics.
• Civil disturbance.
• Transportation disruptions.

16. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Sultanate of Oman.

Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Oman.
